I've had that problem a couple of times in OSX, and haven't found any way around it, aside from this: remove the item from the trash and put it on your desktop or in the root directory of your hard drive. restart in OS9, then trash and delete the file. restart in OSX - all done! Other than that, I've got no clue, OSX seems to have some major problems with this kind of stuff, I have to do this routine pretty regularly on all my machines - I don't know what I'll do if I ever encounter an OSX only machine

Try renaming the file and then try to trash it. If you are familiar with the Terminal cd to the folder that contains the file that you cannot trash. Then type sudo rm -fr F F represents the name of the file you want removed. Hit Return. It will ask you for your password, enter your password then hit return and voila no more file. Cheers

This is due to the fact that the file you're trashing is locked. I ran into this problem, went to the help menu and typed in something like "trashing locked files". I can't remember the exact keystrokes, but I'm pretty sure you just hold down the Option key while emptying the trash. This was in OS X by the way.

Chris is correct Again!! The way most of us empty is with the keystroke Com/Sh/Del...Butt... With a file that you cannot empty with the krystroke... You hold option down, and select "empty trash" from the file menu...

unfortunately holding down 'option' works well in OS9, but it does nothing in OSX (despite the 'help' file declaring otherwise). I've had several instances where items in the trash wouldn't delete, and holding down option did not help at all - had to go to OS9 to get rid of it. I'll try the terminal approach next time though, just to see.
